These Terms of Service ("Terms") govern your use of the websites, services, and content provided by Growth Factory, LLC, a Wisconsin limited liability company located at 1710 Bellewood Drive, Waunakee, WI 53597 ("Growth Factory," "we," "us"). By using our website or reserving a service, you agree to these Terms. If you do not agree, please do not use the service.
1. The service
Growth Factory designs, builds, and hosts websites for small businesses. We may prepare a draft website for a business to review. A business can request corrections, ask us to remove a draft, or reserve the website as a subscription. We provide only the capabilities described on this site; we do not promise features we do not list.
2. Samples and drafts
Example websites and postcards shown on this site are illustrative samples created by Growth Factory and do not represent real customers. A draft we prepare for a business is a proposal for that business to review; it is not a claim that the business is our customer, and it can be corrected or removed on request.
3. Accurate information
If you reserve a website, you agree to provide accurate information about your business and to have the right to use any content, names, or images you ask us to include. You are responsible for the accuracy of the business information presented on your site.
4. Subscription and payment
Paid websites are offered as a subscription: $49.99 per month on a 12-month agreement, with no setup fee. Billing, cancellation, refund, and dispute terms are described in our Subscription, Cancellation, Refund & Dispute Policy, which forms part of these Terms.
5. Acceptable use
You agree not to use the service for unlawful, deceptive, or harmful purposes, not to request content that infringes others' rights or violates the law, and not to attempt to disrupt or gain unauthorized access to our systems.
6. Intellectual property
Growth Factory retains ownership of its platform, software, templates, and designs. Content you provide about your business remains yours, and you grant us the permission needed to use it to build and host your website. You may not copy or resell the Growth Factory platform itself.
7. Corrections, removal, and takedown
You may request corrections or removal at any time by emailing hello@growth-factory.ai. We may also remove or decline to publish content that violates these Terms or the law.
8. Availability and changes
We work to keep hosted websites available, but the service is provided on a reasonable-efforts basis and may occasionally be unavailable for maintenance or reasons beyond our control. We may improve or modify the service over time.
9. Disclaimers
The service is provided "as is" and "as available." We do not make guarantees about specific business results, traffic, rankings, or revenue, and we make no warranties beyond those required by law.
10. Limitation of liability
To the maximum extent permitted by law, Growth Factory is not liable for indirect, incidental, or consequential damages. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the twelve months before the claim.
11. Termination
You may cancel as described in the subscription policy. We may suspend or end the service for violations of these Terms, non-payment, or where required by law. When the service ends, we stop hosting the website.
12. Governing law
These Terms are governed by the laws of the United States and of the State of Wisconsin, without regard to conflict-of-laws rules. Nothing in these Terms limits rights you may have under mandatory consumer-protection laws that apply to you.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify subscribers by email. Continued use after an update means you accept the revised Terms.
